1. Acceptance of These Terms

These Terms of Service govern the use of this website and the mountain condo rental service provided by Parkwest Hafen Holdings, LLC. By visiting the site, sending an enquiry, confirming a booking or staying in a condo that we manage, you agree to these terms. If you do not agree with them, please do not use the service or complete a booking.

When you book on behalf of a group, you confirm that you are authorised to accept these terms for every guest travelling with you. You are responsible for sharing the relevant rules with the group, including the quiet hours, the occupancy limit and the parking arrangements. A breach of these terms by a member of the group is treated as a breach by the person who made the booking.

These terms should be read together with the written booking confirmation that the desk issues for each stay. If the confirmation states a specific arrangement that differs from a general rule here, the confirmation governs that arrangement. Nothing in these terms removes a right that the law gives you and that cannot be waived by agreement.

2. Who We Are

Parkwest Hafen Holdings, LLC is a property services company that operates a mountain condo rental desk at 2815 E Wanda Way, Holladay - 84117-4645, United States (US). The desk telephone number is +17348492036 and the rental email address is rentals@rdfutahcondos.lat. In these terms, we, us and our refer to Parkwest Hafen Holdings, LLC, and you and your refer to the person making a booking or using the website.

The company manages a small collection of condos on behalf of their owners. Depending on the unit, the company acts as the letting agent for an owner or as the operator of the rental. In both cases the desk is your single point of contact for the booking, the keys and the support during a stay.

3. Scope of the Service

The service offered through this site is short term and extended stay lodging in mountain condos, together with the guest services and property care described on the services page. The desk arranges reservations, issues keys, supports guests during a stay and walks each unit between stays.

We are not a real estate agency, a travel agency, a ski school or a tour operator. We do not sell lift passes, lessons or guided activities as principal. Where we mention a local business, the arrangement for that service is between you and that business. We may help by passing on a recommendation, but we do not guarantee the quality of a third party service or accept liability for it.

We may decline an enquiry where a condo is not suitable for the group, where the requested dates are not available, or where accepting the booking would breach a rule applied by the owner or a local authority. Where we decline, we will explain the reason in writing where it is lawful to do so.

4. Booking and Confirmation

A booking is made when the desk issues a written confirmation and the required deposit has been received. An enquiry, a quotation or a hold on a date is not a confirmed booking. The desk may place a short courtesy hold while a guest arranges payment, but a hold expires at the time stated in the message.

The confirmation states the condo name, the address, the arrival and departure dates, the number of guests, the total price, the deposit paid and the payment schedule. Please check these details and tell the desk within forty eight hours if something is incorrect. After that period the confirmation is treated as agreed.

The named guest on the confirmation must be at least eighteen years of age and must be present at check in. The desk may ask for photographic identification at the counter. A booking may not be transferred to another person without written agreement from the desk.

We reserve the right to correct an obvious pricing or availability error before a confirmation is issued. If a confirmation has already been issued and an error is discovered, we will contact you promptly and offer either a corrected price or a full refund of any amount paid.

5. Rates, Taxes and Fees

The rate for a stay is quoted in United States dollars and includes the base rent for the condo. The confirmation itemises any cleaning fee, applicable lodging tax, a damage deposit where one applies, and any optional service that you have requested. The total shown on the confirmation is the amount payable unless a change is agreed in writing.

Rates depend on the season, the length of stay and the particular condo. A weekly or monthly rate may be available for an extended stay. The desk will tell you when a longer booking qualifies for a different rate, and will not apply a higher rate retroactively to a booking that is already confirmed.

Taxes are charged at the rate that applies at the time of booking. If a tax authority changes a rate or introduces a new charge that applies to your stay, we will pass on the change and show it clearly on a revised confirmation. We do not add undisclosed fees at check out.

6. Payment and Deposits

A deposit is required to confirm a booking. The amount and due date are stated in the confirmation. The balance is due before arrival, at the time set out in the confirmation. For an extended stay, the confirmation may set out monthly payments rather than a single balance.

We accept payment by card through a regulated processor and, where agreed in advance, by bank transfer. We do not accept cash at check in for a balance that is already due. A booking may be released if the balance is not received by the due date, after the desk has made reasonable attempts to contact you.

A refundable security deposit may be required for certain units or group bookings. The deposit is held against damage, excessive cleaning or a breach of the house rules, and is returned by the method stated in the confirmation after the departure walk through. We aim to process a return within fourteen days of departure.

Card details are handled by the payment processor. We receive a confirmation of the transaction and limited card information for reconciliation, but we do not store the full card number or the security code.

7. Cancellation and Changes

Our cancellation terms depend on how far in advance you cancel and, for winter bookings, on the season. The schedule that applies to your reservation is printed in the confirmation. As a general guide, a cancellation made well before arrival returns the deposit less any agreed administration amount, while a cancellation close to arrival may forfeit the deposit or a larger part of the total.

If you need to change the dates of a stay, contact the desk as soon as possible. We will try to move the booking to another available period in the same condo. A change is confirmed only when the desk issues a revised confirmation. A difference in rate may apply if the new dates fall in a different season.

If we must cancel a booking for a reason within our control, we will refund all amounts paid for the affected nights and, where possible, offer a suitable alternative condo. If the alternative is not acceptable, the refund is your full remedy for the cancellation.

Where a cancellation is required by a public authority, a road closure or another event outside our control, the force majeure section below applies.

8. Check In and Check Out

The standard arrival window and departure time are stated in the confirmation. The desk issues keys at the counter on 2815 E Wanda Way or, by prior arrangement, through a secure lock box. Keys must never be left in an unsecured location or passed to a person who is not named on the booking.

Please tell the desk in advance if you expect to arrive after the counter closes. A late arrival can usually be accommodated with a lock box arrangement, provided the request is made before the desk closes that day. An unannounced late arrival may mean waiting until the next working day.

Check out is by the time stated in the confirmation. A later departure may be possible where the next arrival allows it, and must be agreed with the desk rather than assumed. Keys must be returned by the method instructed. A key that is not returned, or is returned to the wrong place, may attract a lock change charge.

Before departure please close the windows, turn off unnecessary lights, place used towels in the bathroom and leave the kitchen in a reasonable state. The cleaning team handles the rest.

9. Occupancy and Guest Conduct

Each condo has a maximum occupancy stated on the unit map board and in the confirmation. The limit includes children and overnight visitors. Exceeding the limit is a breach of these terms and may result in additional charges or in the end of the stay without refund.

Guests must behave in a way that respects the neighbours, the property and the shared areas. The condos sit in residential pockets, and many neighbours live in the area year round. Loud music, parties, smoking inside the unit and the use of the property for commercial activity are not permitted.

The person who made the booking is responsible for the conduct of the group and for any damage caused during the stay. Where a guest causes a disturbance that requires intervention by the desk or by the authorities, the booking may be terminated and the group asked to leave. In that case no refund is due for the remaining nights.

Guests must not move furniture between condos, remove linens or kitchen equipment, or alter the fixtures. Requests for an extra chair or a cot should go to the desk, which will supply one from stock where available.

10. House Rules and Quiet Hours

Quiet hours run from 22:00 to 07:00. During quiet hours, televisions, music and conversation should be kept at a level that cannot be heard from a neighbouring unit or from outside the building. Hot tubs and outdoor areas, where a condo has them, are not to be used during quiet hours.

Smoking and vaping are not permitted inside any condo, on balconies or within twenty feet of an entrance. A cleaning charge applies where smoking is detected in a unit. Open flames, including candles and portable heaters, are not permitted. A wood stove, where fitted, may be used only in accordance with the instructions left in the unit.

Guests must not sublet a condo, host an event, or allow a person who is not on the booking to stay overnight without telling the desk. Fire exits and shared corridors must be kept clear. Bicycles and ski equipment must be stored in the designated area rather than in corridors or on balconies.

The full house rules for each condo are included in the arrival card. By accepting a key you accept those rules in addition to these terms.

11. Pets and Service Animals

A small number of condos are designated pet friendly. A pet may stay only where the booking confirmation states that the unit is pet friendly and the pet has been declared at the time of booking. An undeclared pet is a breach of these terms, and the desk may require the guest to remove the animal or may end the stay.

Where a pet is accepted, the guest agrees to keep the animal under control at all times, to use the designated outdoor areas, to clean up after the animal and not to leave it alone in the condo for long periods. A pet fee may apply and is shown in the confirmation. The guest is responsible for any damage caused by the animal.

Service animals are welcome in all condos in accordance with applicable law. Please tell the desk in advance so that the cleaning team can prepare the unit appropriately. A service animal is not subject to a pet fee.

12. Parking and Vehicles

Parking arrangements vary by condo. The confirmation states how many vehicles may be parked and where. A parking pass may be required and must be displayed as instructed. Vehicles parked without a pass, or in a space belonging to another unit, may be towed at the owner expense.

Please do not block a neighbour driveway, a fire lane or a snow removal route. In winter, vehicles must be moved when the plow is due so that the lot can be cleared. The desk will post a notice in the arrival card when a specific plow schedule applies.

We do not provide secure storage for trailers, boats or recreational vehicles unless the confirmation says so. Charging an electric vehicle is permitted only at a designated charging point.

13. Damage, Loss and Security Deposits

Guests are asked to report any damage or loss to the desk as soon as it happens. A prompt report allows the team to repair the item before the next arrival and usually keeps the matter simple. We do not penalise a guest for fair wear and tear or for a genuine accident that is reported promptly.

Where damage results from carelessness, a breach of the house rules or an unreported incident, the cost of repair or replacement may be charged. Charges are based on the actual cost of the repair, the replacement value of the item or a reasonable cleaning charge where that is the remedy. We will provide a written explanation and any supporting invoice on request.

Where a security deposit is held, a charge is deducted from it and the balance is returned. Where no deposit is held, the charge is invoiced to the person who made the booking. Charges may not exceed the actual loss and are not used as a penalty.

Missing keys, lost parking passes and broken remotes are charged at the replacement cost stated in the arrival card. A lost key may require a lock change for the safety of the next guest, and that cost is passed on.

14. Limitation of Liability

We take the safety and comfort of our guests seriously, and we maintain the condos in a good condition. However, we cannot accept liability for every event that may occur during a stay. To the extent permitted by law, Parkwest Hafen Holdings, LLC is not liable for indirect or consequential loss, for loss of profit or opportunity, or for loss arising from a third party service that you arrange independently.

We do not accept liability for personal property that is lost, stolen or damaged during a stay, except where the loss is caused by our negligence. Guests are encouraged to keep valuables secure and to use the safe where a unit provides one. Vehicles and their contents are parked at the owner risk.

Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, for fraud, or for any other liability that cannot be excluded by law. Where our liability is established and may be limited, it is limited to the amount paid for the stay to which the claim relates.

15. Weather, Roads and Force Majeure

Mountain weather is unpredictable. Snow, ice, wind, avalanche control and road closures can affect travel to and from a condo. The desk monitors conditions and will contact guests when a closure is likely to affect an arrival or departure, but we cannot guarantee that a road will be open at a particular time.

Neither party is liable for a failure to perform an obligation where the failure is caused by an event outside reasonable control, including severe weather, a natural disaster, a public health emergency, a government order, a utility failure or a labour dispute. In such a case we will work with you to move the dates, provide a credit or refund the amounts paid for the affected nights, depending on what is practical and fair.

Where a guest chooses to leave early because of weather, a refund is not automatic. The desk will consider the circumstances and the terms in the confirmation, but a shortened stay due to personal preference is treated as a voluntary departure.

16. Website Use and Intellectual Property

The content of this website, including text, layout, illustrations, code and the design of the rental desk pages, is owned by Parkwest Hafen Holdings, LLC or is used with permission. You may view the site and print a page for your own use in connection with a booking. You may not copy, republish or use the content for a commercial purpose without written permission.

You agree not to misuse the website. Misuse includes attempting to gain unauthorised access to the server, introducing malicious code, scraping the site at a volume that affects service, or using the contact form to send spam or unlawful content. We may restrict access where we reasonably believe that misuse has occurred.

The Parkwest Hafen Holdings, LLC name, the rental desk design and any related marks are the property of the company. Nothing on this site grants a licence to use them.

17. Privacy

We handle personal information in accordance with the Privacy Policy published on this site. The policy explains what we collect, why we collect it, how long we keep it and how you can exercise your rights. By using the service you acknowledge that you have read the policy.

If these terms and the Privacy Policy appear to conflict on a matter of data protection, the Privacy Policy prevails. Questions about privacy can be sent to rentals@rdfutahcondos.lat or raised by telephone on +17348492036.

18. Complaints and Disputes

If something is not right during a stay, please tell the desk immediately rather than waiting until you leave. Most problems can be resolved the same day, whether it is a heating issue, a noisy appliance or a missing item. The desk keeps a record of the report so that the matter can be followed up properly.

If you are not satisfied with the response, you may send a written complaint to Parkwest Hafen Holdings, LLC at 2815 E Wanda Way, Holladay - 84117-4645, United States (US), or by email to rentals@rdfutahcondos.lat. Please include the booking reference, the dates and a clear description of the issue. We will acknowledge the complaint within five working days and aim to provide a full response within twenty one days.

We will try to resolve a dispute through discussion and, where appropriate, a fair adjustment to the booking. If a dispute cannot be resolved directly, the governing law section below applies.

19. Governing Law

These terms are governed by the laws of the State of Utah and the laws of the United States that apply there. Any dispute that cannot be resolved directly will be brought in a court of competent jurisdiction in Utah, unless the law of your place of residence gives you the right to bring the matter in another forum.

If a provision of these terms is found to be invalid or unenforceable, the remaining provisions stay in effect. A failure to enforce a provision on one occasion does not waive the right to enforce it later.

These terms, together with the booking confirmation and the Privacy Policy, form the entire agreement between you and Parkwest Hafen Holdings, LLC in relation to the service.

20. Changes to These Terms

We may update these terms from time to time to reflect a change in the service, the law or the way the desk operates. The current version is published on this page with the date of the last update. For an active booking, the terms that applied when the confirmation was issued continue to govern that stay, unless a change is required by law or is agreed in writing.

Where a change is material, we will make it clear on this page and, where we hold an email address for a booking that may be affected, send a short notice. Continued use of the website after an update indicates acceptance of the revised terms.
